La llegada de la pandemia COVID-19 el año 2020 cambió la vida de la humanidad en todos sus ámbitos y lo hizo a nivel global. En este escenario de incertidumbre los Estados y sus instituciones debieron tomar medidas para contenerla y a su vez continuar cumpliendo con su misión y funciones, procurando así entregar seguridad y certezas a los ciudadanos y ciudadanas respecto de la continuidad de nuestra vida en sociedad.
Como Poder Judicial, conscientes de lo fundamental que resulta en situaciones de excepción contar con tribunales de justicia que resuelvan oportunamente los asuntos que son sometidos a su conocimiento, definimos una estrategia para asegurar la continuidad del servicio judicial en medio de la pandemia y el confinamiento. Esta estrategia fue posible gracias a medidas que anteriormente veníamos desarrollando como el trabajo a distancia y el uso intensivo de nuevas tecnologías en la tramitación de causas y atención de usuarios y usuarias.
La pandemia nos planteó un gran desafío, debimos adaptar rápidamente nuestras rutinas familiares y laborales, modificar nuestros hábitos, trabajar desde nuestros hogares, ser más flexibles y fomentar nuestra creatividad, lidiando con el temor a esta enfermedad desconocida.
Responder a este reto fue posible gracias al convencimiento que cada una de las personas que forman parte de nuestra institución tiene respecto de la importancia de nuestra misión y que su cumplimiento debe siempre tener como foco el servicio a la ciudadanía.
Teniendo en consideración la situación referida presento la Memoria Digital del Poder Judicial 2020, en la cual se refleja la labor realizada por la Corte Suprema y sus distintos comités (Personas, Modernización y Comunicaciones), las cortes de apelaciones y los tribunales de primera instancia de todo el país, además del trabajo de la Corporación Administrativa del Poder Judicial y la Academia Judicial. La labor realizada, no obstante la pandemia, nos permite enfrentar de mejor manera el actual escenario.
Un punto a destacar durante el ejercicio en cuestión es el importante paso dado en el proceso de Planificación Estratégica 2021-2025. El 2020 se definieron y reformularon nuestros ejes estratégicos: impacto en la sociedad, gestión de personas, modernización y relaciones interinstitucionales.
Asimismo, junto con adaptar el sistema laboral a la nueva realidad de distanciamiento social y teletrabajo, nos hemos esmerado día a día por reforzar el acceso a la justicia para todas las personas, especialmente para aquellas que ven infringidos sus derechos, por cuanto la pandemia golpea con mayor crudeza a quienes están en condición de vulnerabilidad.
Respecto a la gestión de los recursos del Poder Judicial, puedo reseñar que en lo concerniente a infraestructura, como parte del plan quinquenal de inversiones, se avanzó decisivamente en la inauguración, desarrollo y construcción de nuevos centros de justicia y tribunales. Inauguramos la nueva Corte de Apelaciones de San Miguel, que permite atender las necesidades de justicia del sector sur de Santiago. Asimismo, inauguramos el Juzgado de Letras con competencia común de Cabo de Hornos, permitiéndonos llegar a la zona más austral del mundo con nuestro servicio de justicia. Y, junto al destacado colega y amigo, ministro Carlos Aránguiz, quien ya no nos acompaña, inauguramos el moderno Centro de Justicia de Rancagua, cuyas instalaciones albergan los juzgados civiles, el Juzgado de Familia y de Letras y del Trabajo y brindan servicio a toda esta jurisdicción. En Concepción, por su parte, abrimos las puertas virtuales de las nuevas dependencias del Primer Juzgado Civil de Concepción.
En materia de uso de nuevas tecnologías, destaco el reforzamiento de la página web del Poder Judicial y la Oficina Judicial Virtual que permite recibir más 12 millones de escritos y demandas anualmente. Asimismo, el uso de todos los canales remotos del Poder Judicial para enfrentar la pandemia.
En materia de inclusión y mejoramiento del acceso a la justicia de grupos vulnerables, quiero destacar el intenso trabajo de difusión de la política de atención de usuarios y usuarias al interior del Poder Judicial y el programa de mejoramiento de acceso a la justicia para personas con discapacidad.
Un elemento a destacar que guarda relación con los grupos que merecen una especial atención y protección por parte del sistema de justicia, es la consolidación de la ley de entrevistas videograbadas para niños, niñas y adolescentes víctimas de delitos graves, cuya primera etapa inició su funcionamiento el 3 de octubre de 2019 en las jurisdicciones de Arica y Paricanota, Tarapacá, Antofagasta, Maule, Aysén y Magallanes, concretándose un cambio de paradigma histórico en relación al trato y abordaje de este grupo particularmente vulnerable. Esta nueva ley ha podido implementarse gracias al trabajo y coordinación de los actores involucrados, que pudo sortear las complejidades impuestas por la situación sanitaria, perfeccionarse y avanzar en la preparación y formación especializada de todos los operadores de la segunda etapa, trabajo cuya entidad y características fue aún más desafiante y que se inicia el 3 de junio del 2021.
Durante 2020 se consolidó la política de género y no discriminación al interior del Poder Judicial, gracias a la realización de diversos talleres y seminarios en línea en todo el país, visibilizando esta temática y generando nuevos y mejores procedimientos internos para enfrentar el acoso sexual y la discriminación en cualquiera de sus formas.
Sin perjuicio de la labor realizada el 2020, este 2021 enfrentamos un escenario lleno de desafíos producto de la gran cantidad de causas acumuladas durante la pandemia, un presupuesto ajustado por la emergencia sanitaria y aforos reducidos y acotados en nuestros tribunales y oficinas que nos mantienen trabajando con las medidas de excepción dispuestas.
Destaco la importancia del proceso de construcción de una nueva Constitución para Chile, la que debe garantizar la independencia y autonomía del Poder Judicial, asegurando las condiciones necesarias para cumplir con nuestra labor de proteger los derechos de todas las personas, contribuyendo de esta forma al fortalecimiento de nuestra democracia.
Seguiremos trabajando en mejorar la gestión y el servicio que brindan los tribunales de justicia, con un claro énfasis en las personas como principal motor de nuestro desarrollo sostenible.
Termino estas palabras con un profundo agradecimiento a todas y todos los funcionarios que durante este año se han adaptado a esta nueva realidad, trabajando desde sus hogares y/o de manera semipresencial, para seguir brindando un servicio de justicia oportuno y de calidad. También agradezco a los gremios del Poder Judicial, los cuales desde sus respectivos roles, participaron con sus propuestas en la solución de diferentes problemáticas para mantener el servicio judicial. Finalmente, rindo un especial y sentido homenaje a las funcionarias y funcionarios que nos dejaron a causa de esta enfermedad; en su recuerdo se ha escrito esta memoria.

The arrival of the COVID-19 pandemic in 2020 changed humanity’s life in every way and at a global level. Within this scenario of uncertainty, states and their institutions had to take measures to contain it and at the same time, to continue fulfilling their mission and functions, trying to deliver safety and certainty to the citizens regarding the continuity of our life in society.
As a Judiciary, aware of how essential it is in exceptional situations to have courts of justice that solve at the appropriate time the issues that are submitted to its knowledge, we established a strategy to ensure the continuity of the judicial service in the middle of a pandemic and confinement. This strategy was possible thanks to the measures that we were developing previously, such as remote work and the intensive use of new technologies in administrative proceedings and customer service.
The pandemic created a great challenge. We had to quickly adapt our work and family routines to modify our habits to work from home, to be more flexible and to encourage our creativity, dealing with the fear of this unknown disease.
Meeting this challenge was possible thanks to the conviction that each person that belongs to our institution has regarding the importance of our mission, and that its compliance must always have as its focus service to citizens.
Considering the aforementioned situation, I present the Memoria Digital del Poder Judicial 2020, which reflects the work made by the Supreme Court and its different Committees (People, Modernisation and Communication), the Courts of Appeal and Courts of first instances from all over the country, as well as the work of the Administrative Corporation of the Judiciary and the Judicial Academy. The work carried out, notwithstanding the pandemic, allows us to better confront the current scenario.
An important aspect during the exercise in question is the important step in the process of Strategic Planning 2021-2025. In 2020, our strategic principles were defined and reformulated: social impact, people management, modernisation, and inter-institutional relations.
Moreover, along with adapting the working system to the new reality of social distancing and remote working, we have been putting a lot of effort every day into strengthening access to justice for all, especially for those whose rights are infringed, since the pandemic hits those in vulnerable conditions the hardest.
Regarding the resource management of the Judiciary, I can highlight that in terms of infrastructure, as part of the five-year investment plan, decisive progress was made in the inauguration, development and construction of new justice centres and courts. We opened the new Courts of Appeal of San Miguel, that allow us to meet the needs of justice from southern Santiago. Moreover, we opened the Civil Court with common competition of Cabo de Hornos (Cape Horn), allowing us to reach the southernmost part of the world with our justice service. And, along with our distinguished colleague and friend, Minister Carlos Aránguiz, who is no longer with us, we opened the modern Justice Centre of Rancagua, whose facilities are home to Civil Courts, the Labour and Family Courts which serve the entire jurisdiction. In Concepción, on their behalf, we opened the virtual doors of the new offices of the First Civil Courts of Concepción.
In matters of the use of new technologies, I emphasize the reinforcement of the Judiciary website and the Virtual Judicial Office that allows us to receive more than 12 million documents and lawsuits annually, in addition to the use of all the Judiciary remote channels to face the pandemic.
In matters of inclusion and access to justice for the improvement of vulnerable groups, I want to highlight the intense work of the customer service policy inside the Judiciary and the access to the justice improvement program for disabled people.
An important aspect that is related to the groups that deserve special attention and protection by the judicial system, is the consolidation of the law on videotaped interviews for children and teenagers who are victims of serious crimes, with the first stage starting its operations on the 3rd October 2019 in the jurisdictions of Arica & Parinacota, Tarapacá, Antofagasta, Maule, Aysén and Magallanes. A historical paradigm shift is taking shape related to the treatment and approach of this particularly vulnerable group. This new law has been implemented thanks to the work and coordination of the participants that could navigate the complexities imposed by the sanitary situation, improve and progress in the preparation and specialised training of all operators on the second stage, a task whose entity and characteristics were even more challenging and that starts on the 3rd June 2021.
During 2020, gender and non-discrimination policy inside the Judiciary was consolidated, thanks to the fulfilment of different workshops and seminaries online throughout the country, drawing attention to this topic and generating new and better internal procedures to face sexual harassment and discrimination in any form.
Notwithstanding the work made in 2020, in 2021 we face a scenario full of challenges due to the large number of accumulated lawsuits during the pandemic, a tight budget because of the sanitary emergency and reduced and limited capacity in our courts and offices that keep us working with emergency measures in place.
I highlight the importance of the process of building a new Constitution for Chile, which must guarantee the independence and autonomy of the Judiciary, ensuring the necessary conditions to fulfil our work to protect people’s rights, thereby contributing to the strengthening of our democracy.
We will keep working on improving the management and service of the courts of justice, with a clear emphasis on the people as the main driving force of our sustainable development.
I end these words with deep gratitude to all the public workers that have adapted to this new reality during this year, working from home or in a hybrid way, to keep giving a timely and quality justice service. I also express my gratitude to the Judiciary labour unions, which in their respective roles, participated with their proposals in the solution of different challenges to keep the judicial service. Finally, I pay a special and heartfelt tribute to the public workers who have left us due to this illness. This memorial has been written in their memory.
